What types of construction contracts do you work with?
The practice works primarily with FIDIC-based forms — the Red Book (design by employer), the Yellow Book (design by contractor), and the Silver Book (EPC/turnkey) — as well as bespoke Thai-language construction and development agreements. NEC forms and sub-contract arrangements are also handled. If your project uses a form not mentioned here, please enquire directly.
How long does a contract review typically take?
For a standard mid-sized contract, written commentary is typically returned within five to eight working days of receipt of the full contract documents. Complex or multi-volume contracts, or engagements requiring urgent turnaround, are quoted separately at the time of instruction.
Can you support projects that are already under construction?
Yes. The project counsel engagement is designed precisely for live projects. Instruction can begin at any stage of the construction phase — at the start, mid-project, or when a specific issue arises. An initial review of the project's current legal position is included at the start of each new engagement.
Do you represent only developers, or also contractors?
The practice acts for all parties in the construction chain — employers, developers, main contractors, sub-contractors, and project management companies. Conflicts are checked at instruction. Where a conflict exists with an existing client on the same project, the practice will advise accordingly before accepting instruction.
Are your fees fixed or billed hourly?
The starting fees shown on this site — ฿4,600 for a contract review, ฿24,400 for a construction phase engagement, and ฿39,000 for a multi-year programme — are programme entry figures. Final fees are agreed in writing at the start of each instruction, based on the scope and complexity of the matter. Hourly billing is used only where scope cannot reasonably be fixed in advance, and always with prior client agreement.
Can you advise on dispute resolution under Thai construction contracts?
Yes. Thai construction contracts typically provide for negotiation, mediation, or arbitration as dispute resolution steps. The practice advises on the selection and operation of each mechanism, including the preparation of notices, DAB referrals under FIDIC, and arbitration under Thai Arbitration Institute rules or ICC rules for international projects.
